{"id":2287,"date":"2019-10-02T13:12:06","date_gmt":"2019-10-02T11:12:06","guid":{"rendered":"https:\/\/cjimoz.org\/news\/?p=2287"},"modified":"2020-08-30T12:04:12","modified_gmt":"2020-08-30T10:04:12","slug":"in-gods-name-to-tax-heaven-we-are-not-nurses-or-priests-we-are-here-for-tourism","status":"publish","type":"post","link":"https:\/\/cjimoz.org.mz\/news\/en\/in-gods-name-to-tax-heaven-we-are-not-nurses-or-priests-we-are-here-for-tourism\/","title":{"rendered":"In god\u2019s name to tax heaven \u2013 \u201cWe are not nurses or priests, we are here for tourism\u201d"},"content":{"rendered":"<figure class=\"wp-block-image\"><img fetchpriority=\"high\" decoding=\"async\" width=\"650\" height=\"433\" src=\"https:\/\/cjimoz.org\/news\/wp-content\/uploads\/2019\/10\/Arco-1-650x433.jpg\" alt=\"\" class=\"wp-image-2284\"\/><\/figure>\n\n\n\n<p>By Est\u00e1cio\nValoi<\/p>\n\n\n\n<p><strong>Arco\nIris a supposed Christian and charity institution ruled by Heidi Baker under\nthe shade of saving souls&nbsp; in god\u2019s name\nenriching themselves involving millions of dollar from illicit tourism, tax\navoidance and evasion, illegal business activities.<\/strong><\/p>\n\n\n\n<p><strong>Our\ninvestigation stated in 2011 the first time we interviewed the Ministry Arco\nIris in Pemba City of Cabo Delgado including customer service department, other\nlocal organization working of children supporting areas, social affairs and\nmigration department to the&nbsp; current year\n2019.<\/strong><\/p>\n\n\n\n<p><strong>Hopeless,\nthese people find themselves \u2018protected under institutions\u2019 such as Ministry\nArco Iris \u2013 Comunh\u00e3o da Colheita in Mozambique, a \u2018non-profit\u2019 organization(s)\nwhich started in 1995 in Maputo. Later, in 2014, it established in Pemba City\nin front of the beautiful luxurious coastal line where their office is based,\nthen embarked on acquiring land by huge hectares, some for agricultural\nactivities. With at least three companies opened, they went on to the expensive\nlands in the luxurious coast line of Maringanha \u2013 Pemba city, for the\nconstruction of a luxurious complex composed by a five-star hotel, Gym,\nuniversity, football field and got also involved on illegal tourism business.<\/strong><\/p>\n\n\n\n<p>Mozambican\nRepublic Bulletin granted by the Gender, Children and Social Ministry \u2013 under\nformer Minister Cid\u00e1lia Manuel Cha\u00faque Oliveira, \u201cArco IRIS registration in\nMozambique \u2013 BR approved by the ministerial Diploma n\u00ba 278\/2010, from December\n31 (2\u00aa Via, Despatch published in BR of Mozambique, n.\u00ba 142, III\u00aa Series, from\n2016 November 28 Arco \u00cdris \u2013 Iris Ministries, INC).\u201d&nbsp; It contradicts itself and the Christian\ninstitution eligibility to develop commerce, industry, tourism activities.<\/p>\n\n\n\n<p><strong>BR \u2013\nChapter I, Article One, Denomination and Nature, <\/strong>\u201cMAI \u2013 Ministry Arco Iris is a collective person of\nprivate law on the national scale with no lucrative means, ruled by the\nMozambican legislation.\u201d <\/p>\n\n\n\n<p><strong>Accordingly\nto Arco&nbsp; Iris Constitution on ARTICLE\nFourth <\/strong><strong><\/strong><\/p>\n\n\n\n<p><strong>(Subject) <\/strong><strong><\/strong><\/p>\n\n\n\n<p>One) MAI \u2013\naligned A) MAI allowed to exercise the following activities: promote and hold\nChristian cults&nbsp; with God, then under\nlegal&nbsp; permission and deliberation of its\nGeneral Assembly implement other complementary activities with the objective of\nachieving their purposes; b) Promote and coordinate actions to help children\nand&nbsp; un-vulnerable or vulnerable youth;\nc) Support&nbsp; social and community\nintegration&nbsp; through agricultural\nproduction, small animal production; d) Children protection, education, and\nchild training, establishing different level education and teaching in\naccordance with the national education system; e) Protection and promotion of\nchildren itys health via implementation of preventive medicine care and\nrehabilitation; f) implementing services based on specialized technicians in\nthe scientific areas, teaching in MAI education establishments at all the\nlevels; g) Import and commerce of material and technical and educational\nequipment.<\/p>\n\n\n\n<p>The\nMozambican law, under the Commercial Code (ARTICLE 14\n) states that: \u201cCollective people&nbsp; with\nnon-profit interests are forbidden to exercise any business corporation\nactivity (commercial).\u201d This applies to Ministry Arco Iris as a collective\nperson with the object of its nature being on spiritual and immaterial\ninterests. So IRIS and its subsidiary Christian Religious organization\n\u201cComunh\u00e3o da Colheita, both spiritual and immaterial non-profit institutions\ncannot exercise commercial or business corporation activities.\u201d<\/p>\n\n\n\n<p>This\nmeans that IRIS cannot implement commercial and tourism activities, and the\nconstruction of the luxury complex with hotel, gym is illegal.<\/p>\n\n\n\n<p>This,\ncoming from IRIS\u2019 administrator S\u00e9rgio L\u00e1zaro Mondlane in an interview tree years ago with our investigator,\nthe Christian \u2018non-profit\u2019 organization was providing a free health clinic,\nfeeding programs, agriculture projects, drilling wells, bible&nbsp; teaching,&nbsp;\nprimary and secondary schools,&nbsp;\nuniversity, hotel, gym, Bible schools, to be constructed in a land\nalready acquired in Maringanhe, in the neighborhood of Pemba City.<\/p>\n\n\n\n<p>\u201cFrom\nthere, the ministry has expanded to include more well-drillings, free health\nclinics that service the poor and sick, feeding programs, primary and secondary\nschools, cottage industries and now over 5,000 churches in Mozambique and a\ntotal of over 10,000 churches in over 20 nations,\u201d where ARCO&#8217;s headquarters is\ncurrently based since 2004.<\/p>\n\n\n\n<p>Their\nactivities seem impressive, legitimate, lucrative, which explains the tourism\nempire and its wealth, not only in massive portions of land, mansions, yachts,\nsmall aircrafts allegedly to transport children and members from the center.\nBut in the end it gets rented by an ambassador to fly to Ibo Island and spend\nhis holydays.<\/p>\n\n\n\n<p>The\ncenter is supporting about \u201c7,000 children last year 2013 and later today 2014,\n125.\u201d It is not clear where all the money comes from, what facilities in the\nname of the religion they bring to these people in need into Mozambique. The\nfact is that, using god\u2019s name, the senior members of the organization are\nbecoming rich, the institution became the major touristic establishment in Cabo\nDelgado and some of their activities are unknown by the majority of the people\nin the Province, including some government officials (Individuals).&nbsp; Says Lazaro <\/p>\n\n\n\n<p>According\nto a high internal at Arco Iris Ministry Centre, not all the children inside\nthe institution were in need, with poor living conditions, collected from the\nstreets, \u2018Instead of giving an opportunity to other children, they would enroll\ntheir nephews and nieces, even workers\u2019 children were taken to the center and\ntold not to open their mouths by their own internal family members. It was\ndishonest.&nbsp; <\/p>\n\n\n\n<p>Apparently,\nthe year after IRIS connived with the local social affairs department\nresponsible for the children\u2019s tutelage, rules changed. Social affairs had to\ncarry on an inquiry to find out if the child was really in need, an orphan, and\nonly then admitted into the institution. <\/p>\n\n\n\n<p>\u201cArco\nIris itself has never collected children from the street. Arco Iris just wants\nto help some children. And an investigation was held by Cabo Delagado\u2019s social\naffairs department, and they discovered that&nbsp;\nsome children had their parents working in the institution. They also\ntook into consideration children whose parents are alive but live in poor\nconditions to remain in the center until they reach eighteen years old of age,\nwhen it is time to leave the center, back to their families. Arco Iris would\nthen carry on paying their studies in the university in case the child wished\nto continue.\u201d<\/p>\n\n\n\n<p><strong>Tax avoidance and\nevasion&nbsp; <\/strong><\/p>\n\n\n\n<p>According\nto the Mozambican law there is a \u2018free taxation\u2019 import of goods for religious\ninstitutions such as charities, churches, non-profit organizations. Arco IRIS,\nunder free taxation on god\u2019s tax heaven , has avoiding and evading tax evasion,\ncarrying on with illegal tourism, business . As the group of lawyers we our\njournalist did&nbsp; contact and as they stated\n\u2018 Accordingly to the Mozambican law, under the\nCommercial Code (ARTICLE 14 )some\nof this organizations have as they payments high amounts on salaries,\nadministrative and equipment costs to justify the tax issues. And in the case\nof IRIS they are not allowed to be involve in business, tourism activities.<\/p>\n\n\n\n<p><strong>Tourism<\/strong><\/p>\n\n\n\n<p>As\na touristic institution, thousands of foreigners \u2013 1,200 people from the USA \u2013\nannually arrive in Pemba and today tuition is $4,000 per person \u201conly for\nlogistic. Very expensive.\u201d Flight ticket, health insurance, food\u2026 not included.\nAlso visa and \u201cplease also note that Iris Global has a corporate account with\nLAM. If you turn in a copy of your LAM schedule to the hospitality contact at\nPemba, Heidi Baker will get mileage credits!<strong>&nbsp; <\/strong>\u201cThe IRIS website states\nthat the average per year is 1,300-1,400 people\u201d. But the number of visitors is\nmore than what is claimed by the administrator. And after application contacts\nare done directly by email.<\/p>\n\n\n\n<p>According\nto the Mozambican Police reports in Pemba, during the first semester of 2013\nthey registered 55,464 foreign visitors, a small reduction compared with the\nsame period of 2012 a registration&nbsp;\n55,537. Many visa entries were family visits, gas prospection (work),\nbusiness and tourism. What kind of visas are their visitors using, how many\nreally come to Mozambique? If we sum up the number or \u2018alleged missionaries in\ntourism per year, could be 14,000 guests * 4,000 USD = 5,600,000 USD minimum.<\/p>\n\n\n\n<p>While\ninvestigating and as Lazaro suggested to \u201c The\nperson has to do its own booking, all the spenditures , the missionarie its responsability. This amount only refers\nto our stayed here in Mozambique. Then we have to pay more USD 2000 for our\nflight ticket, visa issues,&nbsp; some\ntourists,&nbsp; alleged missionaries as IRIS\ndefend, told our journalist traveling with them on LAM flight from JHB to\nPemba- Mozambique 2014.&nbsp; All increased. \u201c\nWhen i say USD 4000 , this amount ios for all the logistic part. flight\nticket are&nbsp; missionaries their&nbsp; own expenses.\u201d&nbsp; Enphasises Lazaro<\/p>\n\n\n\n<p>&nbsp;M<strong>issionaries &#8211;&nbsp; tourists <\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" width=\"650\" height=\"433\" src=\"https:\/\/cjimoz.org\/news\/wp-content\/uploads\/2019\/10\/Arco-2-650x433.jpg\" alt=\"\" class=\"wp-image-2285\"\/><\/figure>\n\n\n\n<p>There\nare two sides, each with its own school. There are the missionaries that live\nhere, in Mozambique, which have been here for a long time. Basically those who\nhave a DIRE, a document that says they can live in Mozambique. Some have\ncontracts, with their own DIREs. Those who come for a short period are\nvisitors. In this case, some come to participate in this school and some come\nas tourists, coming to see the work of the institution.<\/p>\n\n\n\n<p>The\npeople cannot distinguish that there are the missionaries, which for the school\nis from June to August, about 3 months. After that there is a 1 month break and\nthen in middle October others come. In between that period some come to visit.\nThere is a specific number of the school itself, and each week or each month\nsome visitors come and go. Those are the ones that say they come for tourism in\nMozambique.<\/p>\n\n\n\n<p>\u201cThe\naverage of tourism visitors depends on the season. For example, now you can get\nten or eight, but in the season to come it will be a busy season, a season with\nmany people and just now there will be a high flow and dynamics all along the\ntown. An average, maybe a maximum of eighty are visitors. Because they come\nfrom many places, sometimes it\u2019s thirty, others fifty, twenty, two or three. So\nthose numbers increase. Maybe a maximum of a hundred or less. Maybe that is the\nnumber I can give in this period of June to December.\u201d<\/p>\n\n\n\n<p>As\nLazaro Arco Iris&nbsp; Lazaro \u201cHere we do have our children its daily meals, the same food for the missionaries\nor they can go and eat outside.\u201d fact is the normal is to see on the\nstreets&nbsp; groups of these&nbsp; alleged missionaries having their daily meals\nin Pemba restaurants, shopping bags of food in local shops and take with them\ninto IRIS huge&nbsp; compound, and\n\u201cmissionaries- visitants per year 700,900, 1200. In August we have about 400\nand something, the number reduce in October, December to around 300.\u201d <\/p>\n\n\n\n<p><strong>Specialized IRIS\nmarketing department on tourism<\/strong><\/p>\n\n\n\n<p>Church,\nArco Iris its branch around the world also via IRIS GLOBAL, a major worldwide\nChristian NGO, with huge properties keep promoting , publicizing about their\ntourism destination from Europe, mainly US from where 90% of the people are\ncoming from, all the way to Pemba. \u201cWe have to limit the number of missionaries because we always fully\nbooked .\u201d Says Lazaro<\/p>\n\n\n\n<p><strong>Travel\nagency and IRIS <\/strong><\/p>\n\n\n\n<p>Following\nthe instruction stated on the Ministry its website ,for Heidi Baker, to keep accumulating&nbsp; mileages from all the thousands of tourists\nallowing her to use this mileages -free flights, Baker advise all the travelers\nto avoid traveling by bus from JHB to Maputo proposing their business travel\nagency \u2018 Dana\u201d . <\/p>\n\n\n\n<p>\u201cHowever,\nthis service is unreliable and has many other inconveniences. We do not\nrecommend this alternative to our visitors. Please note that the Mozambican\nAirlines (LAM) is currently not part of the International Airline Reservation\nSystem. Booking flights, therefore with LAM can be a challenge. Currently, the\neasiest way to book LAM flights for domestic travel in Mozambique is through\nthe Dana Agency in South Africa. Phone them or work with them by email.\u201d<\/p>\n\n\n\n<p><strong>Mileage-money\nfor group of people its benefits <\/strong><\/p>\n\n\n\n<p>According\nto sources Heidi and her small group of friends have considerable benefits,\nfrom travelling to staying in luxurious hotels, a fact that those inside the\nIRIS ministry do not deny or accept: \u201cit is difficult to say she does it. She\nis a very popular figure in Mozambique and even more abroad. I cannot say for\nsure if that happens because she is a worker and maybe she is preaching in\nother places and being given other income for herself. She is not in charge of\nthe money and accounts of the institution.\u201d<\/p>\n\n\n\n<p><strong>Properties and the\nbusiness <\/strong><\/p>\n\n\n\n<p>The\nadministrator, S\u00e9rgio L\u00e1zaro, in his statements during our interview held in\n2012 and later in 2014, and 2018, as our sources, confirm that IRIS has a small\n6-8 seater airplane, a boat (Yacht), industries such as \u201cIRIS Industry and\nother two companies, lands including one 57 ha&nbsp;\nunder dispute managed by other people.\u201d<\/p>\n\n\n\n<p>&nbsp;\u201cMaybe the hotel will become house for the\nteachers of the coming university. I would believe that the children at some\nstage will benefit. Iris has many bursaries, which it is giving to some\nyoungsters in Pemba Catholic University (UCM),\u201d said L\u00e1zaro.<\/p>\n\n\n\n<p>But\nthe second small aircraft, after the first one crashed, and the yachts were\nnever intended to transport children or, as S\u00e9rgio says, boats \u201cfor medicine\ndistribution in remote areas,The small aircraft was bought with money from donation\nto make trips. Not only private trips for pleasure to the islands or countries\nalso to divulge God\u2019s word\u201d\nbut mainly for touristic activities, rented by tourists on their holidays,\nincluding ambassadors in their holidays to Quirimbas Archipelago in Cabo.<\/p>\n\n\n\n<p><strong>Arco Iris and Comunh\u00e3o da Colheita are the same\ninstitution<\/strong><\/p>\n\n\n\n<p>\u201cArco Iris\nis a NGO looking to charity, vulnerable, helping communities here and in the\ndistricts and \u201cComunh\u00e3o na Colheita\u201d is the Church, that is why we do have\npeople going out to spread God\u2019s word, raising awareness. But both\norganizations share the same house and we cannot say that these cars belong to\nthis one or that,\u201d says our fourth IRIS internal source. But the perception of\nPemba\u2019s tourism chain, children social support institutions or entities is not\nclear. \u201cWe don\u2019t know what is Arco Iris really doing. We see their people\ncoming and eating is our restaurant,\u201d as Peter and others say.<\/p>\n\n\n\n<p>By creating\nthe \u2018Comunh\u00e3o da Colheita\u201d name as its main branch, they can now cover some\nillegal activities. The Ministry is still involved in land disputes involving\n57ha which cost the Ministry 50,000 USD. Because Arco Iris cannot be involved\nin business, it has been trying to change the process and use \u201cComunh\u00e3o da\nColheita\u201d. The process is on hold in the provincial agriculture department.<\/p>\n\n\n\n<p><strong>Where\ndoes the money come from <\/strong><\/p>\n\n\n\n<p>According\nto the organization\u2019s constitution, the money comes from donations, offers,\nother partners including IRIS Global the \u2018main partner, private companies,\nincluding the Church Comunh\u00e3o da Colheita \u201cIRIS is Comunh\u00e3o da Colheita present\nin almost the entire world our mainly offer colector.\u201d and the organization\u2019s annual budget is estimated in USD 6,363,636.36\n\u201cfor activities that are not even known, We do have this school,-it is small\nschool with two classrooms&nbsp; inside our\ncompound with capacity to accommodate 3.500 students. Until last year 2011 we\nwere teaching 9 grades. For this year 2012 will introduce 10 grade but the majority are extern students ,Internal children are only&nbsp;\n132. \u201dsaid S\u00e9rgio L\u00e1zaro.&nbsp; <\/p>\n\n\n\n<p>Our\njournalist was back in&nbsp; IRIS in 2014 and was&nbsp; informed that the number of classroom did\nincrese to about 30 and one IT room. But the number of rooms we saw were less\nthan 15.<\/p>\n\n\n\n<p><strong>Discrimination <\/strong><\/p>\n\n\n\n<p>The\nIRIS constitution states on its Article 8, the ministry is based under (Rights)\na) Equal participation on their activities. But in reality the \u2018rights\u2018\nimplementation differs. \u201cConfusion between nationals and foreigners,\ndiscrimination, superiority\u201d&nbsp; and as our\nother internal source says&nbsp; \u201csuperiority\nis what makes damage sometimes. But the problem persists with missionaries\nleading or do the work of local members. The ones that comes to help, in the\nend up do less work than us locals, so they should be so considered lower, and\nso the one that is from here should ascend.\u201d<\/p>\n\n\n\n<p><strong>Land\nconflict <\/strong><\/p>\n\n\n\n<p>IRIS\u2019\nhunger for land was not only about acquiring the Land Right (DUAT) for the land\nwhere the organization is constructing its luxury complex, but also accumulate\nhuge&nbsp; hectares of it around the country,\nmainly in Cabo Delgado, some of them for their empire construction, living\nhouse, classrooms, mansions for the board members. This while the children kept\nliving in houses with low conditions. Also land for commercial agriculture\nactivities such as the land in MIEZE locality \u2013 Pemba, a process with many\nirregularities. From fraud to acquiring the land\u2019s right DUAT to alleged\ncorruption according to the documents in our possession and records from some\ninternal source leading the process.<\/p>\n\n\n\n<p>&nbsp;The Ministry Arco Iris tried to use their\nbranch \u2018Comunh\u00e3o da Colheita\u2019 after the Cabo Delgado agriculture department\nrefused to grant them the permit. Other mischievous attempts were used, though\nfrustrated. That is said by our internal source in the business whose name will\nnot be revealed for security reasons. \u2018In 2014 IRIS did try to lure the State\nto illegally grant the DUAT. Illegal keeping the land. They wanted to change\nthe DUAT request submitted on behalf of ARCO IRIS\u2019s name to their branch\n\u2018Comunh\u00e3o da Colheita\u2019. But at the end they had to create a commercial society\nand submit the process as investment of foreign institution as the Mozambicam\nlaw demands.\u201d&nbsp; An NGO\ncannot be INCORPORATED, like a commercial society such as Lda!&nbsp; So IRIS had to change from IRIS INC via\nMozambican Foreign Ministry.<\/p>\n\n\n\n<p>With object\nin the agriculture sector (production, consultancy, etc) , the Utopia\nAgrotourism Company,&nbsp; Lda was settled,\nregistered in Mozambique&nbsp; in 2008,&nbsp; land explored. CATU&nbsp; Project&nbsp;\nat the time approved by the Centre for Investment Promotion CPI (CPI ao\nn\u00b004\/2009) had the land from which&nbsp;\nrequired a DUAT via SPGC for the&nbsp;\nabout 57 ha in Mieze-Naminawe. With DUAT granted in 2009, the land use\nhad to start within two years because the owners were foreigners. In terms of\ninvestment, it was about 200,000, employing 45 workers until the day \u201cHeidi\nBaker fell in love with it\u2019 and decided to pay USD 50,000.\u201d\n\nArco IRS had to have\na DUAT on its own name, and from 2010 to 2012 IRIS was struggling to have&nbsp; the Right of Land Use.
